FocusPal Terms of Service

These Terms of Service ("Terms") apply to your access to and use of FocusPal ("the App", "we", "us", or "our"). FocusPal is an iOS app that combines Pomodoro focus timing with Pal companion animations.

FocusPal is operated by the developer listed on the FocusPal App Store product page. If you have questions about these Terms, contact us at support@lifeplusapp.app.

1. Acceptance of Terms

By downloading, installing, accessing, purchasing, subscribing to, or using FocusPal, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

If you download FocusPal from the Apple App Store, the Apple Standard Licensed Application End User License Agreement (Apple Standard EULA) applies to your licensed use of the App to the extent required by Apple. These Terms supplement the Apple Standard EULA. If there is a conflict involving Apple distribution, billing, or licensed application rules, the Apple Standard EULA and applicable App Store rules control.

For App Store distribution, you acknowledge and agree that Apple may enforce relevant terms as a third-party beneficiary where applicable.

1.1 Things You Should Know

• Some parts of these Terms may apply only to certain users or regions. If applicable law gives you mandatory consumer rights that cannot be waived, these Terms do not limit those rights.
• You confirm that you are not located in a country or region subject to applicable sanctions or embargo restrictions and are not listed on any applicable government prohibited or restricted party list.
• The current version of the App does not require account registration, but some features may require a local anonymous app user ID, App Store purchase entitlements, or third-party service capability.

2. Service Description

FocusPal provides features including:

• Pomodoro focus timing, short breaks, and long breaks;
• Local reminders, focus history, statistics, and settings;
• Pal creation, naming, prop selection, generation, and animation display;
• Background, appearance, and app experience settings;
• Usage analytics and product improvement supported by Firebase Analytics;
• Optional premium features provided through subscriptions, one-time purchases, or other App Store products.

Specific features may vary by device, system version, region, language, app version, subscription status, or paid entitlement.

FocusPal is a productivity and time-management tool. It does not guarantee improved work performance, academic performance, mental health, wellbeing, or any specific result.

3. Accounts and Data

The current basic functionality does not require account registration. The App generates an anonymous installation-level user ID for stable local identity, Pal generation configuration, RevenueCat purchase entitlement checks, and purchase restoration. This ID is not a login account and does not contain your name, email address, phone number, or password.

Your focus records, settings, statistics, and some Pal assets are stored on your device by default. We may use Firebase Analytics to analyze app usage, feature events, sessions, and product performance. Please review the FocusPal Privacy Policy for details about how we process information.

If a future version provides an account system, you must keep registration information accurate and complete and are responsible for protecting login credentials. If you believe your account, credentials, or personal information has been accessed, disclosed, or stolen without authorization, contact us promptly.

4. License

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use FocusPal on Apple-branded devices that you own or control, in accordance with App Store rules.

You do not acquire ownership of FocusPal software, interface, design, branding, copy, graphics, animations, characters, generated app assets, documentation, or other intellectual property by using the App.

5. Pal Content and Generation

You are responsible for the photos, images, names, text, prop selections, or other content you provide to create, update, or regenerate a Pal ("User Content"). You represent and warrant that you have the rights and permissions needed to use that User Content.

You must not upload, request generation of, or use content that:

• Infringes another person's intellectual property, privacy, likeness, publicity, or other rights;
• Includes another person's likeness or personal information without appropriate permission;
• Is illegal, harmful, exploitative, hateful, harassing, deceptive, abusive, or malicious;
• Involves sexual content relating to minors or any exploitation or harm of children;
• Attempts to bypass safety, billing, entitlement, generation-count, or access limits;
• Contains malicious code, attack instructions, or attempts to disrupt the App, service providers, or other users.

You retain your rights in User Content. To provide FocusPal functionality, you grant us and our service providers a limited, worldwide, non-exclusive license to process, transmit, store, copy, modify, and create generated results from User Content. This license is limited to what is needed for Pal generation, animation display, troubleshooting, safety, moderation, and support.

Pal generation may depend on CapPal, Dify workflows, and AI generation services. Generated results may vary, fail, take longer than expected, or not fully match your expectations. For safety, legal compliance, technical reliability, App Store compliance, or enforcement of these Terms, we may refuse, limit, retry, delete, or disable some generation requests or outputs.

6. Premium Features, Subscriptions, and Purchases

FocusPal may offer free features, premium features, one-time in-app purchases, auto-renewable subscriptions, free trials, introductory offers, promotional offers, or lifetime products. Specific product names, periods, prices, renewal rules, trial rules, and included features are shown in the App Store purchase interface before you confirm a purchase.

Purchases completed through the Apple App Store are subject to the following:

• Purchases, or trials that convert to paid subscriptions, are charged to your Apple account;
• Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period or trial period;
• Apple may charge your Apple account for renewal within 24 hours before the end of the current billing period;
• You can manage, change, or cancel subscriptions in your Apple account settings;
• Deleting FocusPal does not automatically cancel a subscription;
• If the App provides restore purchases functionality, you may restore eligible purchases using the same Apple account;
• Refund requests and billing support are handled by Apple under its rules and applicable law;
• Taxes, exchange rates, price adjustments, Family Sharing availability, grace periods, billing retries, and regional purchase rules are determined by Apple and applicable law.

The App may use RevenueCat to manage product display, purchase records, subscription status, entitlement status, and purchase restoration. If your subscription ends, is cancelled, expires, is refunded, or cannot be verified, related premium features may stop being provided after the entitlement period ends or at the time required by Apple.

We do not receive or store your full card number, bank account information, or Apple account password.

7. Acceptable Use

You agree that you will not:

• Use FocusPal for any illegal, fraudulent, abusive, infringing, or harmful purpose;
• Copy, modify, distribute, sell, rent, sublicense, or commercially exploit the App except where permitted by law;
• Reverse engineer, decompile, disassemble, or attempt to extract source code except where expressly allowed by applicable law;
• Bypass, disable, or interfere with purchases, subscriptions, entitlement checks, safety features, rate limits, or access controls;
• Interfere with or disrupt the App, servers, networks, service providers, or other users;
• Upload malicious code or attempt unauthorized access to systems or data;
• Misrepresent your identity or your rights in User Content;
• Use the App or generated results in violation of other terms of service or applicable law.

8. Permissions and Notifications

FocusPal may request permission to send local notifications, access the camera, or access the photo library. You can deny or revoke these permissions in iOS Settings. Some features may not work without the relevant permissions.

Local notifications are reminders only and do not guarantee that a timer, focus session, break, or related task will complete accurately at a specific time.

9. Third-Party Services

FocusPal may rely on third-party platforms or services, including Apple services, StoreKit, Firebase Analytics / Google Analytics for Firebase, RevenueCat, CapPal, Dify workflows, AI generation services, diagnostics, hosting, or support tools. Those services may be subject to their own terms and privacy policies.

We do not control all actions of those third-party services, but we use them only as needed to operate, improve, protect, and support FocusPal.

The App may contain links to external resources, websites, or third-party services. When you access or use those external resources, you should comply with their own terms and privacy policies. We are not responsible for third-party content, availability, actions, or transactions that we do not control.

10. Intellectual Property

FocusPal software, interface, design, name, marks, characters, generated app assets, copy, graphics, animations, and other materials are owned by us or our licensors and are protected by intellectual property laws.

We may use feedback or suggestions you provide without restriction and without compensation to you, to the extent permitted by law.

11. Service Changes and Availability

We may update, improve, modify, suspend, or discontinue FocusPal or any feature at any time, including free features, premium features, Pal generation, backgrounds, statistics, supported devices, supported regions, or third-party integrations.

We do not guarantee that FocusPal will always be available, uninterrupted, secure, error-free, or compatible with every device or future operating system version. You should install updates when available. Older versions may stop working because of platform requirements, security needs, third-party services, or App Store rule changes.

We may temporarily interrupt services for maintenance, system updates, security, third-party service changes, or other reasonable reasons. To the extent permitted by law, we are not responsible for unavailability or delays caused by events beyond our reasonable control, such as infrastructure failures, network outages, platform policy changes, natural disasters, war, strikes, government actions, or other force majeure events.

12. Safety and No Professional Advice

FocusPal is not a medical, psychotherapy, emergency, education certification, employment, or other professional advice service. The App is only intended to support personal focus habits and time management.

Do not use the App inappropriately while driving, in work-safety situations, school-safety situations, caregiving, or other contexts where distraction may cause harm. You are responsible for deciding when and how to use the App safely and reasonably.

13. Disclaimers

To the maximum extent permitted by law, FocusPal is provided "as is" and "as available" without any express, implied, or statutory warranties. We do not warrant merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, productivity, business opportunity, or device functionality arising out of or related to FocusPal.

To the maximum extent permitted by law, our total liability for any claim related to FocusPal is limited to the greater of (a) the amount you paid for FocusPal in the 12 months before the event giving rise to the claim, or (b) USD 10.

These Terms do not limit any liability that cannot be limited by law.

15. Termination

You may stop using FocusPal at any time. If we reasonably believe that you have violated these Terms, created safety or legal risk, abused generation or purchase systems, or used the App unlawfully, we may suspend or terminate your access to relevant features.

Stopping use of the App does not automatically cancel an App Store subscription. You must cancel subscriptions through your Apple account settings.

16. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless us, our affiliates, service providers, licensors, employees, and agents from any third-party claims, losses, liabilities, damages, costs, or expenses, including reasonable attorneys' fees, arising from:

• Your use of or inability to use FocusPal;
• Your violation of these Terms;
• Your infringement of third-party rights, including intellectual property, privacy, or likeness rights;
• User Content you submit, upload, generate, or use;
• Your violation of applicable law or intentional misconduct.

These Terms do not require you to assume responsibility that cannot legally be assigned to you.

17. No Waiver, Severability, and Entire Agreement

Our failure to immediately exercise or enforce any right under these Terms does not waive that right.

If any part of these Terms is found invalid or unenforceable, that part will be adjusted to the closest valid provision permitted by law, and the remaining provisions will remain in effect.

These Terms and the Privacy Policy form the entire agreement between you and us regarding use of FocusPal and supersede previous communications or agreements about the same subject.

18. Assignment

Without impairing your legal rights, we may assign, subcontract, or otherwise transfer some or all of our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, asset transfer, legal requirement, or service operation need.

You may not assign your rights or obligations under these Terms without our prior written consent.

19. Governing Law

These Terms are governed by the laws applicable to the location of the developer listed on the FocusPal App Store product page, unless mandatory consumer protection laws in your location require otherwise.

If applicable law requires that you may assert consumer rights in the courts or authorities of your place of residence, these Terms do not limit those rights.

20. Changes to Terms

We may update these Terms from time to time. If there are material changes affecting your rights or obligations, we will update the "Last updated" date and may notify you through in-app notices, our website, or other reasonable methods. Non-material changes may take effect immediately after publication.

After updated Terms take effect, your continued use of FocusPal means you accept the updated Terms. If you do not agree to the updated Terms, stop using the App.

You may contact us to request a copy of earlier versions of the Terms if we still retain them.

21. Privacy Policy

Your privacy is important to us. Please review the FocusPal Privacy Policy to understand how we process, use, share, and protect information.
